Highlights - Inequalities and social inclusion of children and their families - opinion - 26.6.23 - Committee on Women’s Rights and Gender Equality

On Monday, 26 June 2023, the FEMM Committee debated the draft opinion on “Reducing inequalities and promoting social inclusion in times of crisis for children and their families”.

Social exclusion is a complex and multidimensional phenomenon. Its key drivers are insufficient resources and poverty, but also lack of equal access to goods and services due to various forms of disadvantage, preventing full participation in the society. It is our collective shame that almost 25 million children under the age of 18 are at risk of poverty facing inequalities or social exclusion. Children living in social exclusion are more likely to become adults living in social exclusion. We need to break this dangerous cycle.

The FEMM opinion shall highlight the impact of the economic crisis on inequality, household structure and family model, the need of creation of an economic safety net for children coming from crisis (economic crisis / health crisis (COVID) / war crisis etc.) and present practices for ensuring social inclusion and for children and their families.

Highlights - Rules to prevent and combat child sexual abuse - vote - 27.6.23 - Committee on Women’s Rights and Gender Equality

On Tuesday, 27 June 2023, the FEMM Committee voted on the draft opinion on “Laying down rules to prevent and combat child sexual abuse”.

At least one in five children falls victim to sexual violence during childhood. A 2021 global study found that more than one in three respondents had been asked to do something sexually explicit online during their childhood, and over half had experienced a form of child sexual abuse online. Children with disabilities face an even higher risk of experiencing sexual violence. Despite the fact that the sexual abuse and sexual exploitation of children and child sexual abuse materials are criminalised across the EU, it is clear that the EU is currently still failing to protect children from falling victim to child sexual abuse.

Highlights - Regulation of prostitution in the EU - vote - 27.6.23 - Committee on Women’s Rights and Gender Equality

On Tuesday, 27 June 2023, the FEMM Committee adopted the draft report on “Regulation of prostitution in the EU: its cross-border implications and impact on gender equality and women’s rights”.

The regulation of prostitution is a very relevant and sensitive issue currently debated in several Member States. Deciding which model of prostitution to adopt (legalising and regulating or legalising the unregulated market) is a political decision based on a variety of perspectives and choices. At the EU Member State level, at one end, prostitution is considered a profession (sex-work) and is therefore legal and regulated, while, at the other end it is seen as immoral and thus criminalised.

The objective of this report is to examine different regulatory mechanisms of prostitution as existing in the Member States of the EU and analyse their impact on gender equality and women's rights. It also examines the cross-border implications.

Highlights - European transportation works for women - vote - 27.6.23 - Committee on Women’s Rights and Gender Equality

On Tuesday, 27 June 2023, the FEMM Committee adopted the draft report on “Ensuring European transportation works for women”.

The FEMM report looks into the specific needs of women in relation to transport as well as the employment situation in the sector and how these are reflected in the design of the respective EU policies. Taking into account the need to significantly reduce emissions and become more sustainable, the report examines the impact on users, passengers and employees, and urges action to avoid ensuing transport poverty and exclusion for certain groups. The draft report seeks to emphasise the difficult and different situation women face in transport, and calls for the transport system to become resilient.

Highlights - Parenthood and creation of a European Certificate of Parenthood - opinion - 26.6.23 - Committee on Women’s Rights and Gender Equality

On Monday, 26 June 2023, the FEMM Committee presented the draft opinion on “Jurisdiction, applicable law, recognition of decisions and acceptance of authentic instruments in matters of parenthood and on the creation of a European Certificate of Parenthood”.

The objective of the proposal is to strengthen the protection of the fundamental rights and other rights of children in cross-border situations, including their right to an identity, to non-discrimination and to a private and family life, and to succession and maintenance rights in another Member State, taking the best interests of the child as a primary consideration.

To address problems with the recognition of parenthood for all purposes and close the existing gap in Union law, the Commission is proposing the adoption of Union rules on international jurisdiction on parenthood and applicable law, so as to then facilitate the recognition in a Member State of the parenthood established in another Member State. It is also proposing the creation of a European Certificate of Parenthood that children (or their legal representatives) can request and use to provide evidence of their parenthood in another Member State.

Highlights - 2024 General budget of the EU - opinion - 26.6.23 - Committee on Women’s Rights and Gender Equality

On Monday, 26 June 2023, the FEMM Committee presented the draft resolution on “General budget of the European Union for the financial year 2024”.

The draft opinion for the budgetary resolution notes that the Commission has borrowed billions of euros beyond what was forecast, and asks that money not be wasted on "unproductive ideological fantasies", such as "gender confusion". The opinion urges that the Commission not intrude on member state competence such as sexual education.

The opinion rapporteur identifies possible areas of savings such as SRHR, EIGE and gender mainstreaming.

The FEMM committee has previously voted to increase the budget devoted to topics within its remit, notably the ESF+, the Daphne programme, EIGE, and the fallout from the attack on Ukraine.

Highlights - Hate speech and hate crime - opinion - 26.6.23 - Committee on Women’s Rights and Gender Equality

On Monday, 26 June 2023, the FEMM Committee presented the draft opinion on “Extending the list of EU crimes to hate speech and hate crime”.

Hate speech and hate crime have long been recognised by the European Parliament as a form of crime which should be added to the list of crimes articulated in Article 83(1) TFEU. Hate speech and hate crime can have enormous consequences for individuals or groups that are targeted by these offences. Women are disproportionally victims of hate crime and hate speech. Including hate speech and hate crime in the list of crimes in Article 83(1) TFEU is a step forward in combatting this scourge, and would move the EU closer to its ideals and values, including gender equality.

The rapporteur calls for the Council decision to be concluded as swiftly as possible, and for it to include an explicit definition. Noting the origins and consequences of hate speech and crime, the rapporteur calls for the Commission to actively research, analyse and report on anti-gender movements, including their strategies and funding.

Gender mainstreaming is firmly established in Article 8 of the TFUE: "In all its activities, the Union shall aim to eliminate inequalities, and to promote equality, between men and women." Gender mainstreaming represents the integration of the gender perspective into every stage of policy processes with a view to promoting equality between women and men. As a monitoring tool, the FEMM committee draws up a regular report on gender mainstreaming in the work of the European Parliament.

On Monday, 5 June 2023, the FEMM Committee jointly with the LIBE Committe debated a draft report on the directive on "Preventing and combating trafficking in human beings and protecting its victims".

The draft report calls for improvements to the proposal in relation to financial compensation for victims, guarantees of their immunity for cooperation in investigations, fight against online crime, financial penalties for convicted legal person, training for professionals, early identification and support for victims among applicants for international protection, criminalisation of any user, whether aware or unaware, of services provided by a victim of trafficking, and data collection.
