On 11 May 2023, IMCO and LIBE adopted a report on the AI Act by co-Rapporteurs are Mr Brando Benifei (S&D, IMCO) and Dragoş Tudorache (Renew, LIBE). The report includes important amendments to the legislative proposal, such as a ban on predictive policing, a number of additions to the list of stand-alone AI categorised as high-risk and a strong and inclusive role for the new AI Office.

Moreover, a stronger alignment with the GDPR is proposed, as is an increased involvement of stakeholders in several areas, as well as the introduction of specific provisions related to general purpose Artificial Intelligence.

Members tabled approximately 4000 amendments to the proposal, on which compromises were elaborated.

Plenary voted in favour of the report on 14 June 2023. The first trilogue was held on 14 June 2023. The co-Rapporteurs will report back on the proceedings during the LIBE meeting of 28 June 2023.

IMCO is preparing a draft report to establish to what extent the implementation of the Geo0Blocking Regulation (GBR) has contributed to the integration of the internal market and thereby, to better deals for consumers and more opportunities for business. The Rapporteur is Ms Beata Mazurek (ECR), who present the draft report at the committee meeting of 28 - 29 September 2023. The deadline for amendments is 12 July 2023.

The GBR ensures that customers in the EU have access to online interfaces, goods and services, and that they are not discriminated against on the basis of their means of payment. The regulation also prohibits restrictions on passive sales, i.e. when a trader receives unsolicited requests from customers located in a territory in which the trader is not active. At the same time, traders are not obliged to deliver cross-border unless their general conditions already provide for cross-border delivery in the country of the customer.

In 2020, less than 2 years after the entry into application of the regulation, the Commission published a report on the implementation and potential extension of the regulation.

IMCO is preparing a report, with Mr Andreas Schwab (EPP) as Rapporteur, on the proposal for a Regulation establishing the single market emergency instrument and repealing Council Regulation No (EC) 2679/98. On 28 March 2023, the Rapporteur presented the three draft reports on the SMEI legislative package. The discussion on the amendments took place on 25 April with the participation of EFTA representatives.

The Rapporteur suggests to strengthen the resilience aspects throughout the proposal in order to ensure the smooth functioning of the Internal Market during crises and changed the name of the regulations accordingly. The draft reports focus in particular, on promoting solidarity, free movement and fast lanes, ensuring supply-chain resilience through stress tests, trainings, voluntary crisis protocols and exchange of best practices on strategic reserves, as well as easing the burden on companies. The Rapporteur also introduces targeted changes to the two accompanying proposals to make sure that free movement of harmonised and non-harmonised goods is facilitated across the Union. The draft reports were broadly welcomed by the Shadows, who also insisted on cutting red-tape for businesses and citizens, as well as on greater transparency and involvement of Parliament.

The vote is planned for July 2023.

Other events - IMCO Delegation to Japan - 15-05-2023 - Committee on the Internal Market and Consumer Protection

On 15-19 May 2023, ahead of the G7 summit in Hiroshima, a delegation of seven Members chaired by Ms Christel Schaldemose (S&D) travelled to Japan. The main aim of the delegation was to learn about the Japanese regulatory approach to digital products and services, as Japan is one of the world leaders in the sector, with over 300 registered AI-related companies.

In Tokyo and Kyoto, the delegation met with the Minister for Digital Transformation and the Minister for Internal Affairs and Communication, the Japanese parliament, academia and private companies. Information gathered will funnel current work on the digital dossiers of the Committee.

Other events - IMCO delegation to Singapore - 03-04-2023 - Committee on the Internal Market and Consumer Protection

On 3-7 April 2023, an IMCO delegation of seven Members travelled to Singapore. Primarily, the delegation wanted to focus on customs, which is one of the core responsibilities of the Committee. The members of the delegation were Ms Maria Grapini (S&D), Mr Andreas Schwab (EPP), Mr Ivan Štefanec (EPP), Ms Tsvetelina Penkova (S&D), Mr Morten Løkkegaard (Renew), Ms Alessandra Basso (ID), and Mr Adam Bielan (ECR).

Singapore hosts the world's biggest port for goods and many of these goods are destined for the EU market. Secondly, in light of the Committee's work on the EU digital single market, the delegation wanted to learn from Singapore's experience with its productivity drive to facilitate the transformation into a digital economy, as well as consumer protection in digital markets.

Additionally, as Singapore is a part of ASEAN, being the business hub of the association, the delegation met with representatives of ASEAN businesses based there and which are exporting goods to the EU. This, in order to learn about their experiences on access to the EU market, especially on issues related to EU customs and custom controls.

Subject files - Working Group on the Implementation of the Digital Markets Act - Committee on the Internal Market and Consumer Protection

At their meeting of 12 September 2022, IMCO Coordinators established a working group intended to scrutinise the implementation of the Digital Markets Act and report back its findings to the Committee. The working group is chaired by Parliament's rapporteur, Mr Andreas Schwab (EPP) and is composed of the Shadows from the political groups in IMCO, as well as the rapporteurs of the associated committees.

In Mr Schwab's words: ''Work on the implementation of the DMA is just starting. We're here to make sure the work gets done".

The third meeting of the working group o took place on 24 May 2023. On the basis of interventions by experts and Commission representatives, Members discussed matters around interoperability for social networking services; the complementary nature of the DMA and Articles 101 and 102 TFEU; and the possible interplay of the Metaverse and the DMA.
The next working group meeting is envisioned to take place in September.

On 28 March 2023, IMCO adopted a draft report by Ms Biljana Borzan (S&D) on empowering consumers for the green transition. The report seeks to ensure a high level of consumer protection and focuses on the importance of tackling unfair commercial practices, such as dark patterns and early obsolescence, among other issues. The report also highlights the need to provide reliable and useful information on products. In addition, the report makes dual quality of goods an unfair commercial practice.

The first trilogue took place on 1 June 2023. The second on 26 June.

"To truly empower consumers for the green transition we have to, on one side protect them from unfair practices, and on the other side to enable them to make easy sustainable choices. It is time to end practices such as early obsolescence, unsubstantiated environmental claims or misleading advertising based on offsetting. We are happy to have concluded another round of negotiations. We believe that good progress can be made in the best interest of our citizens and our environment." - Biljana Borzan, Rapporteur.

The next trilogue is planned for 19 September 2023.

Subject files - Financial services contracts concluded at a distance - Committee on the Internal Market and Consumer Protection

On 28 March 2023, IMCO adopted a report on the proposal concerning financial services contracts concluded at a distance. The Rapporteur is Ms Arba Kokalari (EPP). With this report, IMCO wants to uphold a high level of consumer protection, ensure legal clarity for companies without administrative overburdening and enable new technological developments in financial services through technological neutrality.

The report provides for:

Clear rules on what information must be provided prior to concluding a contract
Simple, legible and quick withdrawal function from contracts online
Consumers protected from manipulative practices and "dark patterns" online.

A provisional political agreement between Parliament and Council was reached on 6 June 2023.
The Rapporteur said: "With more consumers buying financial products online, the consumer protection rules need to be fit for the digital age. I am glad that we managed to conclude a deal today. This will ensure strong consumer protection online and make it easier for consumers to withdraw from contracts. Now we will have clear and modernised rules, without putting extra burden on companies".

The text of the provisional agreement needs to be formally adopted by Parliament and Council. IMCO will vote on the text on 29 June 2023.

Hearings - Online safety of vulnerable consumers (minors) - 29-06-2023 - Committee on the Internal Market and Consumer Protection

Making the online world a safe, positive and inclusive environment for children is a key IMCO priority. Children are accessing the internet from an increasingly younger age and across a wide range of devices, with or without adult supervision. This leaves them vulnerable to a number of risks, including exposure to illegal and harmful content, dark patterns, privacy infringements and commercial targeting. The hearing will bring this issue at the forefront of the discussions in Parliament.

Concepts such as, 'safety-by-design' and responsible use of data and platform liability are at the forefront of policy thinking for tech regulation. However, new and emerging technologies, such as augmented and extended reality, as well as artificial intelligence pose new challenges for the protection of vulnerable consumers online. In this regard, this hearing is particularly timely. Given the focus on liability and accountability issues of the tech industry, also in the context of the DSA, Members will discuss the extent to which these regulatory efforts are enough to ensure positive and age-appropriate experiences for young people online. The hearing is also an opportunity to explore what more needs to be done to embed considerations around online child protection in the design, development and deployment of digital products, services and platforms - even if their services are not primarily targeted at minors.

Subject files - Transparency and Targeting of Political Advertising - Committee on the Internal Market and Consumer Protection

On 2 February 2023, Parliament adopted the IMCO report by Rapporteur, Mr Sandro Gozi (Renew) on the proposed regulation on transparency and targeting of political advertising. ''This report will make abusive online political advertising a thing of the past by making it impossible to prey on people’s specific weaknesses. It will also make political actors more accountable for the adverts they disseminate.” - Mr Sandro Gozi.

The fourth trilogue took place on 27 June 2023. All outstanding political points were discussed. Good will and common understanding emerged and the co-legislators, as well as the Commission confirmed their commitment to progressing on the proposal. Further technical meetings and a political trilogue are to be planned under the upcoming Spanish Presidency of the Council. This, in order to complete the assessment of the draft compromise and reach an agreement, with the aim of applying the new rules in time for the forthcoming European elections. During the committee meeting of 28-29 June 2023, the IMCO Chair gave an update on the proceedings of the trilogue.
